Jacksonville Assault & Battery Lawyer

Though they are similar crimes, assault and battery are two separate types of criminal charges. While both refer to a physical act, assault is the charge that reflects a physical threat made, which causes fear, and is coupled with the apparent ability to cause harm. Battery is the intentional physical touching of another done without their consent, and can be intended to harm or was simply unwanted physical contact.

Assault and Aggravated Assault

The legal definition of assault renders it a threat or the perception of potential, future physical contact. An assault according to Florida law does not actually involve physical contact. An assault charge is considered a second-degree misdemeanor that is punishable by up to 60 days in jail and up to a $500 fine. If the situation that resulted in an arrest involved a weapon, the charge may become aggravated assault, which is a third-degree felony and punishable by up to five years in jail and up to a $5,000 fine. If you are facing assault charges, including assault with a dangerous weapon, assault with a deadly weapon or domestic assault, I can help you understand your rights and options.

Battery and Sexual Battery

There are a variety of degrees of battery charges, ranging from misdemeanors to serious felonies. The severity of the charge often depends on the amount of injurious damage that was inflicted on the alleged victim. Sexual battery is another type of battery charge that is more commonly known as rape. If you are facing any type of battery charge, you may be facing years in jail and large monetary fines. Take action immediately to protect yourself when your future may be in jeopardy. I use my experience to navigate the criminal justice system and aggressively advocate for my clients.
